General Conditions of Use and Sale – Rules of the Game

 

THANK YOU for visiting our website and showing interest in purchasing our items.

While we understand that this is a lot of text, it is important that you carefully read these General Conditions of Use and Sale (the “Rules of the Game”) before proceeding with your purchase, as these Rules of the Game explain specific rules that apply to your use of our website, as well as to your order.

By visiting our websites and purchasing items from us, you indicate that you have read and understood these Rules of the Game.

 

1. Who are we?

 

The terms “we,” “our,” and “us” are used to refer to entities of Ealinvors.

The identity of the selling entity for the items depends on the country where you make the purchase. Please refer to Annex I of these Rules of the Game, including our list of entities, to find your Ealinvors entity.

2. Who can order items through the website?

 

You can order our items if you have reached the legal age under applicable laws and are legally capable of doing so.

We only sell our items to end-users and/or consumers who:

a.     Have a valid address in a region where we deliver our items.

b.     Order the items for their personal use.

c.     Do not resell the items.

We reserve the right to refuse the sale of our items to distributors, retailers, or wholesale buyers. 

 

3. When can you order items through the website?

 

While we do our best to allow you to purchase our items, it is possible that:

a.     An item displayed on our website is no longer available (it might not correspond to the indicated availability).

b.     Additional restrictions may apply to “limited edition” or “limited production” items, for example, restrictions on the number of items you can purchase.

c.     Our internet items may not yet be shippable to all countries or regions. Please refer to our website for the countries and regions to which we ship our items.

 

4. How does the ordering process work?

 

Of course, we are happy that you have decided to order our items. Placing an order through our website is easy and consists of the following steps:

1. Add the items you want to order to your shopping cart.

2. Go to "Order."

(i)    If you already have an Ealinvors account, sign in. Otherwise, you can create your own account by registering on our website.

(ii)   If you place an order as a guest without creating an account, fill in all necessary information (such as your name, address, email address, and phone number).

c.     Check your information and your order before confirming it.

1. Select your preferred shipping method.

2. Choose one of the available payment methods.

3. Before placing an order, you will need to accept these Rules of the Game.

4. Proceed to place the order and pay for the items (at that moment, you enter into a binding obligation). You must complete the payment in the way you have chosen. Until you complete the payment, the items will not be reserved, but as soon as we receive payment confirmation, the order will be executed. This means that if you wait too long to make the payment, the risk of the items no longer being available increases.

5. You will receive an email message with all the details of your purchase. At that moment, a binding contract (the “Purchase Contract”) comes into effect, which includes these Rules of the Game.

6. As soon as we have shipped your items, you will receive a shipping confirmation by email.

 

5. When can we cancel your order?

 

We have the right to refuse or cancel your order before the items are shipped. However, we must have a justified reason for doing so. Some examples of situations in which we may refuse or cancel an order include, but are not limited to:

1. An obvious error or other mistake regarding any of the items we offer.

2. The items are unavailable or out of stock; if that is the case, we will inform you as soon as possible and will not process the order.

3. Your billing information is incorrect or impossible to verify.

4. We have reasons to believe that your order or payment is fraudulent.

5. There is suspicion of credit or debit card fraud.

6. We cannot deliver to the address you provided.

7. We have reasons to believe that you are not an end-user or consumer.

8. You are underage under applicable laws.

9. The purchase payment is not reserved or made in full.

In the above cases, we are not liable for damages or costs arising from the refusal or cancellation of your order.

 

6. What prices does Ealinvors use?

 

The prices on our website are consumer prices and include VAT, but do not include shipping costs.

Prices apply only to purchases through our website and may differ from the prices used for the same items in an Ealinvors store. Prices may change from time to time and differ between countries, but changes will not affect any order we have accepted. The final price to be paid will be displayed on the checkout page.

Not all items and offers we have on our website are also available in Ealinvors stores and vice versa.

Promotions or discounts on our website cannot be combined with other promotions, offers, or discounts. Promotions, offers, and discounts apply only to purchases made through pgqvvnxfpqkwtb@hotmail.com, and may differ from promotions, offers, and discounts that may apply to the same items in an Ealinvors store.

The costs and estimated delivery date of the items will be clearly stated on the checkout page of your order.

 

7. How do you pay for the items?

 

In principle, we will only process and deliver your order after receiving payment.

Ealinvors accepts various payment methods, including credit and debit cards. Additionally, we offer the most commonly used payment methods in a specific country; these can be seen at the bottom of our website's homepage and are listed in our Help Center.

We do not accept other payment methods not mentioned on our website.

We remain the owner of the items until you have paid for them in full. 

 

8. What delivery options do you have?

 

You can choose one of the following three delivery options we offer:

a.     Standard shipping: delivery time and costs vary depending on the country. Depending on your country, we offer free shipping if you place an order for a total amount above a certain threshold (which varies by country). This threshold is visible on the checkout page. If you are logged in as a member of (our loyalty program), you will enjoy free shipping (regardless of the threshold).

B.     Click and Collect: depending on your delivery country, you have the option to place your order online and request package pickup at an Ealinvors store. For more information on Click and Collect, please visit our website.

The delivery times we provide are merely indicative and are not guaranteed. The delivery deadline is 30 days. To the extent possible, we try to inform you of any delays. To the extent permitted by law, we will not assume any liability for damages resulting from a delay in delivery.

 

9. How will your items be delivered?

 

If you choose standard shipping or express shipping, we will deliver your order to the address you provided when placing the order. When we are unable to deliver to your address, we may:

1. Change the address and deliver your order to a neighbor.

2. Try again at another time.

3. Deliver your package to a local pick-up point.

It is important that you check the condition of the package upon receipt. Although you have 28 days to cancel your purchase without reason, if the package is damaged or in a condition you did not expect, you must inform our Customer Service team of the defect as soon as possible, ultimately within two months from the delivery date. See chapter 14 for more information on how to handle defective items and the consequences of not reporting defects to our Customer Service team.

 

10. What can you do if you have not received your order?

 

Please refer to the tracking information for more precise details on the delivery of your items. You can contact our Customer Service team to inquire about the delivery of your package, provided you do so within the following timeframe:

a.     If the tracking information indicates that your order has been delivered, you have 30 days from the delivery date indicated in the tracking information to contact our Customer Service team.

b.     If the tracking information indicates that your order has not yet been delivered, you have 100 days from the order shipment date to contact our Customer Service team.

If you do not contact us within the applicable timeframe indicated above, your request will be automatically rejected.

 

11. You want to cancel your order, what should you do?

 

Although we are very sorry, you have the right to cancel any order without stating the reason, except for items made to your personal specifications, that are clearly customized, and that cannot be returned for reasons of hygiene or health protection.

Our return policy

Please contact our Customer Service team as soon as possible to cancel your order.

If the items have already been shipped or delivered to you, you have 28 days from the delivery date to return them to us. You can return the items 

a.     An Ealinvors store of your choice in a country where we have a European Ealinvors website.

If the Ealinvors store you choose in the European region applies a different currency than the currency in which you purchased your items online, the currency of the Ealinvors store of your choice where you return the items will apply.

As an exception, if you used Clear Pay or Klarna as a payment method for your online purchase, it is not possible to return your items in one of our Ealinvors stores. In that case, you must return the items to our warehouse.

b.     Our warehouse.

If you return the items to our warehouse, do not forget to fill out the return form provided with your order and include it in the box. Place the return label in the transparent bag provided and attach it to the box; if you do not have the return label, please contact our Customer Service team. Drop off your package at the appropriate delivery service access point within 28 days from the delivery date.

In addition to the above return policy, you can use the model cancellation form included in Annex II of these Rules of the Game.

Please note that our return methods may vary by country. Therefore, please refer to our Returns page on our website for more information on the specific return methods for your country.

Returned items must be returned in the condition in which you received them. This means that the items and packaging are in their original, unused, and complete condition. You can only unpack the items if it is necessary to assess their size, nature, and other characteristics. For example, you can try on clothes or shoes to check the size, but you cannot wear and use them. Do not remove the tags when trying on items.

We check the condition of returned items when we receive them. If the items are worn or damaged, we reserve the right to re-communicate the resale value of the items to you.

12. In which cases will Ealinvors not accept returned items?

 

We do not accept returned items if:

a. They are returned more than 28 days after the delivery date. The delivery date is the date the items are delivered to your chosen shipping address, even if the shipping address is a collection point.

b. They were purchased elsewhere than our website or our Ealinvors stores.

c. They are missing tags.

d. They are damaged due to misuse, negligence, or unintentional activity.

 

13. How and when will you receive a refund after cancelling/returning an order/item?

 

In principle, we will refund your purchase amount using the same payment method you used to pay for your online purchase.

We apply the following refund policy:

a. When you return items to an Ealinvors store of your choice

Once we have checked the returned items and concluded that they are in their original, unused, and complete condition, we will refund the amount using the same payment method you used to pay for your online purchase.

b. When you return items to our warehouse

Once we have received the returned items at our warehouse, checked them, and concluded that they are in their original, unused, and complete condition, we will issue a refund within 14 days from the moment the courier accepted your return package. We are entitled to withhold the refund until we have received the items or until you provide proof that you have returned them, whichever occurs first. We will refund you via the same payment method you used to pay for your online purchase.

When you return all purchased items, you will receive the full purchase amount plus standard shipping costs (if applicable). If you chose express shipping, we will not refund express shipping costs beyond the amount of standard shipping costs.

If you return only part of an order, you will receive a refund for the value of the relevant items without shipping costs.

14. What is your legal guarantee and what can you expect if items are defective?

 

Under the legal guarantee, you can expect items to:

1. Be free from defects at the time of delivery.

2. Comply with what was agreed and stated in our offer.

3. Possess the properties necessary for their normal use.


If the items are defective:

a. At the time of delivery, report the defect to our Customer Service team as soon as possible, ultimately within two months from the delivery date.

b. After delivery, report the defect to our Customer Service team as soon as possible, ultimately within two months from the date you discover it.

To have a better chance of resolving potential issues, we ask you to:

1. Clearly state what the defect or problem with the items is.

2. Include several images of the items clearly showing the defect and the overall condition of the items.

We will review your claim and, if necessary, ask you to return the relevant items to our warehouse for inspection and we will contact you to advise on the next steps. In the event of a valid claim under warranty, we will refund the purchase price. If an delivered order is returned in its entirety, we will also refund any standard shipping costs you paid.

If the valid claim relates to a manufacturing defect, the warranty prescribed by the laws of the country in which you reside will apply. These Rules of the Game do not affect your statutory warranty rights. If any provision of these Rules of the Game differs from the warranty rights against you, the corresponding rule will not apply, but the law of the country in which you reside will apply.

If you have not reported any defect to our Customer Service within two months from the delivery date or from when you discover the defect, you accept the package and, therefore, any loss, damage, or reduction in the value of the items will be at your own risk. This means that if the items are lost or damaged after you have accepted them, you will be responsible for such loss or damage and, therefore, will not be entitled to a refund.

 

15. How do you contact Ealinvors?

 

Our goal is to provide excellent service, both online and in our physical stores. Integrity, excellence, service, teamwork, and community are part of our core values. If your experience with us is not of the quality we aim for, please let us know. Tell your story and don't forget to mention which store or Customer Service agent you had your experience with.

You can contact our Customer Service team through the contact form on our website, by sending an email, chatting with our chat bot, or our live chat with a Customer Service agent. If you use our chat bot and live chat, you can request us, via the "Email transcript" button in the chat, to send the chat transcript to your email. If you end the chat with the "End chat" button, the chat transcript will be automatically sent to your email. If you close the chat without using the "End chat" button, you will not receive the chat transcript.

16. How does Ealinvors process your personal data?

 

Ealinvors considers the protection of your personal data to be very important. Please see our Privacy Statement and our Cookie Statement for more information on how we process your personal data.

 

17. What are the rules regarding intellectual property rights?

 

All brand names, logos, product names, corporate and service names, texts, images, illustrations, designs on our website and communications contain intellectual property rights of Ealinvors or third parties. For example, the suppliers of the items, photographers, and creatives. You are not allowed to use or reproduce any expression governed by intellectual property rights, as this may constitute a violation of the owner's rights.

The rights to the design of the website, texts, documents, films, music and/or other services, as well as their selection and arrangement, and all software compilations, underlying source codes, software and any other material on this website are owned by Ealinvors and/or its suppliers and subcontractors, or Ealinvors has a license for them.

You are only allowed to electronically copy and print parts of the website to the extent necessary to place an order with us or to use the website as a shopping resource. You are not allowed to make any other use of the information and materials on this website, including reproduction for purposes other than those mentioned above, modification, distribution, or re-publication. If you wish to use materials or information from this website, you need our prior written approval to do so.

To the maximum extent permitted by applicable law, you hereby indemnify and hold us harmless from all actions, claims, and liabilities that we suffer, bear, or incur as a result of your use and/or exploitation of expressions that infringe the rights (intellectual property) of any third party or that are otherwise illegal towards a third party.

 

18. To what extent is Ealinvors liable?

 

For our items:

In the unlikely event that we do not properly fulfill our obligations to you, we are only liable for direct damages resulting therefrom up to the maximum amount you paid for the items in question. We are not liable for indirect damages that you may suffer. This is without prejudice to the rights applicable to you under mandatory laws that cannot be overridden. Ealinvors does not exclude or limit nor does it intend to exclude or limit any liability that cannot be excluded or limited under applicable laws.

Ealinvors is liable for damages resulting from inadequate performance in case of:

a. Death or physical injury

b. Intentional or reckless misconduct of Ealinvors itself and/or its management

c. Any other damage that cannot be excluded or limited by law

It can always happen that we are unable to fulfill our obligations because something happens beyond our control. We call this "force majeure". The term force majeure includes, but is not limited to, unforeseen events, wars, fires, explosions, accidents, floods, (IT) sabotage, (labor) strikes, lockouts, compliance with laws, rules, regulations or resolutions, or total failure of machinery, apparatus or processes or any other cause, whether or not stated above, that makes our performance of the Purchase Agreement reasonably impossible or unreasonably onerous for Ealinvors.

In case of force majeure, we are entitled to suspend performance or terminate the Purchase Agreement.

Ealinvors is not liable for any costs (for delay), loss, expense or damage that you incur in any way due to a force majeure event, unless Ealinvors inexcusably caused the relevant force majeure event.

For the use of our website:

Our website may provide links to external websites. We are not responsible for your use of our websites or for the content of websites that can be visited via links on our website. The use of links and visiting other websites is at your own risk. Other websites may contain links or frames to our website. We assume no responsibility for damages resulting from such a link or frame.

Although we take reasonable precautions to keep our website free of viruses, we do not accept any responsibility for damages resulting from a virus or transmitted through our website.

 

19. Which laws and jurisdiction apply to your Purchase Agreement?

 

These Rules of the Game are applicable unless mandatory legal provisions conflict with them. If any part of these Rules of the Game is found to be invalid for any reason, this will not affect the validity of the remaining part of the Rules of the Game, and that remaining part will be deemed to remain in full force and effect.

The Purchase Agreement, which contains these Rules of the Game, entered into between Ealinvors and you and the use of the website shall be governed by the laws of the Netherlands, without prejudice to any rights you may have under applicable mandatory laws.

Any dispute arising out of or relating to the Purchase Agreement, these Rules of the Game or the use of the website shall be brought exclusively before the competent court located in Amsterdam, unless within one month of Ealinvors informing you, you choose dispute resolution before the court that would be competent according to applicable law.

The foregoing does not affect your legal rights.

 

20. What other rules apply?

 

We reserve the right to change these Rules of the Game at any time without prior notice, so the new amended Rules of the Game will become effective upon their publication on the website. It is recommended to check regularly whether they have changed. Existing Purchase Agreements will not be affected by such changes.

These Rules of the Game and conditions were last amended in November 2023.

 

21. What are the terms and conditions associated with our gift card?

 

These Terms and Conditions are applicable to physical and electronic gift cards (collectively, "gift cards") from Ealinvors, including Kids Ealinvors. Physical gift cards can be used for purchases in Ealinvors stores in all European countries where Ealinvors issues gift cards. Electronic gift cards can only be used online in the country where they were issued.

When using the gift card for purchases, deductions will be automatically made from its balance. It is not necessary to spend the entire balance in a single purchase. Multiple gift cards can be combined for a single purchase. The gift card cannot be exchanged for cash and will not be replaced if lost or stolen.

The gift card cannot be used to purchase another gift card. The gift card has no expiration date. You can check the gift card balance at any time in an Ealinvors store. The gift card has no value until a balance is acquired.
